9.0-Eberhard Export Control Statements

Policy-It is the policy of Eberhard to properly label all exports of ITAR controlled hardware and technical data in accordance with applicable U.S. Government regulations.

Purpose-The purpose of this policy is to define standard export control statements to be used in conjunction with ITAR controlled exports of hardware and technical data and export of goods controlled by the Department of Commerce.

Procedure-Exports of strategic goods and technical data must be labeled in accordance with the International Traffic in Arms Regulations. The following statements are provided for your reference:

Technical Data-EXPORT SENSITIVE: ITAR CONTROLLED

Information contained herein is subject to the Code of Federal Regulations Chapter 22 International Traffic in Arms Regulations. This data may not be resold, diverted, transferred transshipped, made available to a foreign national within the United States, or otherwise disposed of in any other country outside of its intended destination, either in original form or after being incorporated through an intermediate process into other data without the prior written approval of the US Department of State.

Destination Control Statement (anti-diversion)

The Destination Control Statement is a statement that must be on the invoice and bill of lading, air waybill, transport document or other export control document that accompanies the shipment, as follows:
